Terms & Conditions
| 1. | Incorporation by reference |
| In addition to the General Terms, the Specific Terms and the Acceptable Use Policy (which terms and conditions are deemed incorporated by reference), the Customer shall be bound by the following Terms and Conditions for the SingTel Mobile MobileP@y service (the "MobileP@y Terms"). | |
| 2. | Definitions and Interpretation |
| 2.1 | In these MobileP@y Terms, the following words and expressions shall have the following meanings: "Acceptable Use Policy" means SingTel Mobile’s Acceptable Use Policy (http://home.singtel.com/terms/default.asp?source=mobile&product_name=mobile_aup), being the guidelines for acceptable conduct and use of the Service, including all subsequent revisions or amendments. "Customer" means any person who subscribes for and/or uses the Service. "General Terms" means Singapore Telecommunications Limited’s General Terms and Conditions of Service and Billing Terms. Details at: http://home.singtel.com/terms/default.asp?source=mobile&product_name=general "Mobile Device" means a compatible mobile handset that the Customer needs to access and utilize the Service. "Merchant" means the person who has agreed to participate in the Service and who permits payment for its products and/or services to be made through the Service. "Merchant Products and Services" means the products and/or services in respect of which payment is made by a Customer through the Service. "Service" means the MobileP@y service which enables the Customer to make payments through a Mobile Device for Merchant Products and Services. "SingTel Mobile" means Singapore Telecom Mobile Private Limited and its successors. "Specific Terms" means Specific Terms and Conditions of SingTel Mobile. | 2.2 | The words and expressions used in these MobileP@y Terms that are defined in the General Terms, the Specific Terms and/or the Acceptable Use Policy but are not defined in these MobileP@y Terms, shall have the same meanings as defined in the General Terms, the Specific Terms and/or the Acceptable Use Policy, unless the context otherwise requires. |
| 2.3 | The headings or titles to the Clauses in these MobileP@y Terms are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these MobileP@y Terms. |
| 3. | Use of Service and Registration |
| 3.1 | The Service is available to all pre-paid or post-paid mobile subscribers of any mobile service provider in Singapore. |
| 3.2 | Registration for the Service is required. Customer will need to go to www.mobilepay.sg to register for a MobileP@y account ("Account") in accordance with the instructions contained therein. |
| 3.3 | Each Customer shall have a valid mobile subscription prior to registration of the Account. |
| 3.4 | The Customer shall nominate a credit card and the corresponding credit card details upon registration for the Account. Only VISA, MasterCard credit cards shall be accepted. Only one (1) credit card shall be nominated for each Account irrespective of whether there are any Secondary Numbers (as defined below) assigned to the Account. |
| 3.5 | The Customer shall provide individual identification and security details such as PIN numbers and/or passwords as and when required during registration for the Account. Each Merchant may also provide additional security codes, passwords and/or PIN numbers to Customers and may require these additional security codes, passwords and/or PIN numbers to be verified prior to permitting the Customer to use the Service in respect of its Merchant Products and Services. |
| 3.6 | The Customer may use the Service immediately upon successful registration of the Account but subject always to any further requirements or authorizations specified by each Merchant. |
| 3.7 | Only one (1) Account is allowed to be registered for any one (1) mobile number. If a subsequent registration is made using a previously registered mobile number, the first Account with that mobile number will be automatically locked. If no action has been taken by the Customer to unlock the Account within a period of six [6] months, the Account will automatically be terminated. |
| 3.8 | A Customer may authorise up to a maximum of four (4) additional mobile numbers (“Secondary Numbers”) to access the Customer’s Account and to use the Service to carry out any transactions which the Customer is authorised to transact. For the avoidance of doubt, the Customer’s mobile number used to register for the Account shall be deemed as the primary mobile number of the Account. The Customer acknowledges that all charges for transactions carried out by the Secondary Numbers shall be charged to the Customer’s credit card. |
| 3.9 | The Customer shall make the necessary amendments to the details of their Account from time to time including but not limited to instances where a Customer terminates the mobile number used to register for the Account and/or any changes to the Secondary Numbers. |
| 3.10 | The Customer is required to perform a new registration to obtain a new Account in the event the Customer changes their mobile number. |
| 3.11 | Customers are solely responsible for submitting accurate and valid information during registration. SingTel Mobile may at its sole discretion reject any registration by any Customer and shall not be liable for any failure to register the Account whether arising from insufficient or false information or otherwise. |
| 3.12 | If the MobileP@y account is inactive for 180 days, the account will be automatically locked. If no action has been taken by the Customer to unlock the Account within a period of one [1] year from the day the account is locked, the Account will automatically be terminated. |
| 4. | Termination |
| 4.1 | No termination of the Service is required. Customers may stop using the Service at any time. |
| 5. | Customer’s Acknowledgments and Warranties |
| 5.1 | The Customer acknowledges and agrees that:

| 5.2 | The Customer shall comply with all applicable laws when using the Service and ensure that no unauthorized material or content is obtained, stored, copied, distributed, used or misused in any manner without the consent of SingTel Mobile and/or the Merchant. The Customer shall bear the sole responsibility for use of the Service and all material or content transmitted, downloaded or stored through use of the Service. |
| 5.3 | The Customer acknowledges and agrees that he shall not use the Service in any manner which may adversely affect SingTel Mobile’s network, other Customers’ use of the Service or any other service provided by SingTel Mobile, as SingTel Mobile may reasonably determine. |
| 5.4 | The Customer shall ensure that the Mobile Device is compatible with the Service. SingTel Mobile shall not be responsible to the Customer for any failure of the Mobile Device to access and/or use the Service. |
| 6. | Fees and Charges |
| 6.1 | The Customer may be charged a fee for every successful payment in respect of Merchant Products and Services made using the Service ("Transaction Fee"). The Transaction Fee shall be as determined by SingTel Mobile and notified to the Customer from time to time. |
| 6.2 | The Transaction Fee will be charged directly to the Customer’s credit card as specified in the Account. |
| 6.3 | Each Merchant shall be solely responsible for the billing and collection of all amounts payable for their Merchant Products and Services and shall be responsible for all matters pertaining to credit card transactions including but not limited to security arrangements. All disputes as to payment and credit card transactions shall be the sole responsibility of each Merchant. |
| 6.4 | Prevailing SMS charges (as may be decided by the respective mobile providers from time to time) shall be incurred for the usage of the Service. |
| 7. | Service Limitations and Disclaimers |
| 7.1 | The Customer acknowledges that Service availability is subject to:

| 7.2 | The Customer further acknowledges and accepts that SingTel Mobile:

| 7.3 | SingTel Mobile does not warrant that the Service will satisfy the Customer's requirements or that the Service will be uninterrupted or error free or that defects in the Service will be corrected or that the Service will not damage or interfere with other services or features of the Mobile Device. |
| 8. | Consent to Use and Disclose Information and Data |
| 8.1 | The Customer agrees that SingTel Mobile shall be entitled to use or disclose any information or data disclosed by the Customer in accordance with Clause 15 of the General Terms. The Customer is entitled to withdraw such consent according to the procedure as prescribed by SingTel Mobile from time to time. |
| 9. | General |
| 9.1 | The Customer shall be bound by and shall fully observe and comply with all the General Terms, the Specific Terms and the Acceptable Use Policy as well as such other terms and conditions as may be agreed or accepted by the Customer. The rights and protections conferred on SingTel Mobile under these MobileP@y Terms shall be additional to the rights and protections conferred on SingTel Mobile under the General Terms, the Specific Terms and the Acceptable Use Policy and any other terms and conditions agreed or accepted by the Customer. |
| 9.2 | Any Clause in the General Terms, the Specific Terms, the Acceptable Use Policy or any other terms and conditions as may be agreed or accepted by the Customer, that is invalid, unenforceable or illegal shall be enforced as nearly as possible in accordance with its terms, but shall otherwise be deemed severed and shall not affect the enforceability of any other Clauses, which Clauses shall continue to be valid and enforceable to the fullest extent permitted by law. |
| 9.3 | SingTel Mobile reserves the right to alter, modify, add to or otherwise vary these MobileP@y Terms from time to time in such manner as SingTel Mobile deems appropriate. The Customer shall be bound by the terms and conditions so amended. In any event, if the Customer continues to use the Service after such amendment, the Customer shall be deemed to have accepted the amendments. |
